
The ongoing trial of convicted murderer and rapist Thabo Bester has been delayed once more in the Free State High Court in Bloemfontein, following the appointment of a new legal representative. The hearing, which took place on Friday, 19 September, ended in adjournment after confusion over who would lead Bester’s defence.
Change in Legal Representation
Advocate Lerato Moela, who had been representing Bester in connection with his dramatic 2022 escape from Mangaung Correctional Facility, officially stepped down. Adv. Moafrika Wa Maila has now assumed responsibility for the case and brought his expertise in criminal law into the mix.
During the brief court appearance, the uncertainty about Bester’s representation led to another delay. The trial had already been underway since 2023, but delays have mounted due to legal and procedural challenges.
Charges and Defendants
The case involves multiple accused parties. Alongside Thabo Bester, the charges include his girlfriend, Dr. Nandipha Magudumana; former G4S employees Senowe Matsoara, Teboho Lipholo, Tieho Makhotsa; Magudumana’s father, Zolile Sekeleni; and Zimbabwean national Zanda Moyo.
They are facing a range of serious allegations: aiding a convicted prisoner in escaping lawful custody, fraud, corruption, money laundering, the violation of a dead body, arson, and more.
Concerns over Fair Trial
Advocate Wa Maila has raised concerns that media content—specifically a Netflix documentary about his client—could prejudice Bester’s right to a fair trial. Such productions may influence public opinion and possibly impact court proceedings.
Extradition Dispute
Another complication relates to Dr. Magudumana’s legal team, which is pursuing a case in the Constitutional Court. They challenge the legality of her arrest and extradition from Tanzania in April 2023. Their stance is that her constitutional rights were violated, alleging that the extradition was carried out improperly or under a “disguised” arrangement with the Tanzanian authorities.
New Date Set
Given the change in legal counsel and ongoing legal motions, the trial has been postponed to Friday, 5 December to allow all parties adequate time to prepare.
