The man accused of the brutal rape and murder of six-year-old Amantle Samane has indicated his intention to plead guilty to all charges against him, bringing an emotional case one step closer to conclusion.
Phethe Simiao, a Mozambican national, appeared briefly before the Johannesburg High Court on Monday morning. He faces charges of kidnapping, rape, murder, and immigration-related offences. This development marks a significant shift in the case, as he had previously only been willing to plead guilty to contravening the Immigration Act by living in South Africa illegally.
Tragic Case That Shocked South Africa
Simiao was arrested in October last year after police discovered Amantle’s lifeless body in his rented room in Orlando, south of Johannesburg. The discovery sent shockwaves through the community, sparking outrage and calls for justice from residents and child protection advocates alike.
The young girl’s death was described as horrific, with police confirming that she had been sexually assaulted before being killed. The incident not only highlighted the dangers faced by vulnerable children but also reignited debates about border control, community vigilance, and the justice system’s handling of violent crimes against minors.
Change of Plea
Advocate Ndivhuwo Masindi, representing Simiao, spoke to the SABC outside court, explaining that the decision to plead guilty followed the disclosure of the case docket by the state.
“Before we go on trial, we have to receive copies of the docket, which we did receive,” Masindi stated. “After a thorough consultation with my client, we decided that he will plead guilty on all four counts. He indicated that he did not want to waste the state’s time with a lengthy trial. That is why he has chosen to plead guilty.”
According to Masindi, reviewing the evidence presented by the prosecution was a turning point in their legal strategy. The defense acknowledged that the state’s case against Simiao was strong and that prolonging proceedings would serve no purpose.
Legal Proceedings Postponed
The matter has been postponed to 15 August, allowing the court to finalise other cases currently on its roll before proceeding. During the next appearance, it is expected that Simiao will formally enter his guilty plea, paving the way for sentencing.
The National Prosecuting Authority (NPA) has not yet commented on the possible sentence Simiao could face, but legal experts suggest that the severity of the charges could result in a life imprisonment sentence, especially given the victim’s age and the violent nature of the crime.
Community Reaction
Residents of Orlando and the broader Johannesburg community have expressed mixed emotions—relief that the accused is not contesting the charges, but deep sadness over the loss of young Amantle. Many believe that while the guilty plea may spare the family the trauma of a drawn-out trial, no sentence will ever fully heal the wounds left by the tragedy.
As South Africa watches closely, the upcoming court proceedings will determine not only the fate of Phethe Simiao but will also serve as a somber reminder of the ongoing battle to protect the country’s children from violent predators.
